The Services are hosted in Ireland.

This Terms of Use Agreement ("Agreement") sets forth the legally binding terms for your use of the Services. By using the Services, and in consideration of 3 Clicks Internet Services providing the Services to you, you agree to be bound by this Agreement, whether you are a "Visitor" (which means that you have not registered with the Website) or you are a "Member" (which means that you have registered with the Website as a Registered Estate Agent). The term "User" refers to a Visitor or a Member. You are only authorized to use the Services (regardless of whether your access or use is intended) if you agree to abide by all applicable laws and to this Agreement. Please read this Agreement carefully. If you do not agree with it, you should leave the Website and discontinue use of the Services immediately

Use of Services and additional terms:

This Agreement includes 3 Clicks Internet Services ‘s policy for acceptable use of the Services and content posted on the Website, your rights, obligations and restrictions regarding your use of the Services, your dealings with estate agents and advertisers, and 3 Clicks Internet Services ‘s Privacy Policy. In order to participate in certain Services, you may be notified that you are required to download software or content and/or agree to additional terms and conditions. Unless otherwise provided by the additional terms and conditions applicable to the Services in which you choose to participate, those additional terms are hereby incorporated into this Agreement.

Service to Estate Agents

Once an agent signs up to our property listings service, we will upload your existing property listings for you. We undertake to upload all property listings within 15 working days of sign up and payment date. In reality we would expect to upload your property in a much shorter time frame. Once you have “signed up” and payment has been made, you will be able to upload properties yourself immediately if you wish.

Property Information

3 Clicks Internet Services does not own, has not created and is not responsible for the content of any property information listed on the Website. Property listings and information are provided by Registered Estate Agents (collectively Agents). We do not guarantee that the information that is on the service is accurate, up to date or complete or that any Estate Agent is properly licensed. Content is not checked or confirmed with the relevant Agent prior to being made available on the Website. You should check all information with the relevant Agent. Any contact or dealings you have with an Agent are entirely between yourself and the Agent. 3 Clicks Internet Services does not accept any responsibility or liability for any such contact or dealings. You should check that any Agent is properly licensed. You use this service entirely at your own risk.

You should be aware that the Property Information presented to you as part of the Services may be protected by intellectual property rights which are owned by the Agents (or by other persons or companies contracted on their behalf). You may not modify, rent, lease, loan, sell, distribute or create derivative works based on the Property information without express permission from the owner of such material.

User Submissions

Generally, any communication which you post to the Site is considered to be non-confidential. By posting communications to the website, you automatically grant 3 Clicks Internet Services a royalty-free, perpetual, irrevocable non-exclusive license to use, reproduce, modify, publish, edit, translate, distribute, perform and display the communication alone or as part of other works in any form, media, or technology whether now known or hereafter developed, and to sub-license such rights through multiple tiers of sub-licenses.

As a User, you are responsible for your own communications and are responsible for the consequences of their posting.

Links to and from Other Web Sites

3 Clicks Internet Services does not represent or guarantee the truthfulness, accuracy, or reliability of any of communications posted by other Users or endorse any opinions expressed by Users. You acknowledge that any reliance on material posted by other Users will be at your own risk.

3 Clicks Internet Services does not screen communications in advance and is not responsible for screening or monitoring material posted by Users. If notified by a User of communications which allegedly do not conform to this Agreement, 3 Clicks Internet Services may investigate the allegation and determine in good faith and at its sole discretion whether to remove or request the removal of the communication. Each User hereby agrees that any such action taken by 3 Clicks Internet Services will not be challenged by the User. 3 Clicks Internet Services has no liability or responsibility to Users for performance or non-performance of such activities. 3 Clicks Internet Services reserves the right to expel Users and prevent users further access to the Site for violating this Agreement or the law and the right to remove communications which are abusive, illegal, or disruptive or which 3 Clicks Internet Services otherwise deems to be in breach of these Terms and Conditions of Use.

Security

You are responsible for any misuse of your account, even if the inappropriate activity was committed by a friend, family member, guest or employee. Therefore, you must take steps to ensure that others do not gain unauthorized access to your account. In addition, you may not use your account to breach security of another account or attempt to gain unauthorized access to another network, server or group of servers.

Your password provides access to your account and it is your responsibility to keep your password secure.
Sharing your password and account access with unauthorized users is prohibited. You should take care to prevent others from using your account since you will be held responsible for such use.
New authorised users may be solely created by 3 Clicks Internet Services at the request of 3 Clicks Internet Services registered Estate Agent Users
Attempting to obtain another user's account password is strictly prohibited, and may result in termination of service.
You must adopt adequate security measures to prevent or minimize unauthorized use of your registered account.
You may not attempt to circumvent user authentication or security of any host, network or account. This includes, but is not limited to, accessing data not intended for you, logging into or making use of a server or account you are not expressly authorized to access, or probing the security of other networks. Use or distribution of tools designed for compromising security is prohibited. Examples of these tools include, but are not limited to, password guessing programs, cracking tools or network probing tools.
You may not attempt to interfere with service to any user, host or network ("denial of service attacks"). This includes, but is not limited to; "flooding" of networks, deliberate attempts to overload a service, and attempts to "crash" a host server.
Users who violate systems or network security may incur criminal or civil liability. 3 Clicks Internet Services will cooperate fully with investigations of violations of systems or network security at other sites, including cooperating with law enforcement authorities in the investigation of suspected criminal violations.

Liability

Agreement Term

This Agreement shall remain in full force and effect while you use the Services or you are a Member using services on the site. You may cease your Membership at any time, for any reason, by writing to 3 Clicks Internet Services Customer Services. 3 Clicks Internet Services may terminate any Membership at any time, without warning.

Fees & Charges

You acknowledge that 3 Clicks Internet Services reserves the right to charge for the Services and to change any applicable fees from time to time at its sole discretion. If we terminate any Membership or use of any of the Services because you have breached the Agreement or other applicable terms and conditions you shall not be entitled to a refund of any unused portion of subscription fees except in the case of Registered Estate Agent User Accounts referred to in the Refund section of this agreement.

User Accounts/Login & Password Controls

When you sign up to become a Member of any services offered on the site, you may be asked to choose a password. You are entirely responsible for maintaining the confidentiality of your password. You also agree not to use the account, username, or password of another Member User at any time or to disclose your password to any third party. You agree to notify 3 Clicks Internet Services immediately by emailing info@3clicksproperty.com if you suspect unauthorized use of your account or access to your login and password details. You are solely responsible for any and all use of your account.

Non-commercial Use:

The Services are for the personal use of Users, or where specified, Members only and may not be used in connection with any commercial endeavours except where and to the extent specifically endorsed or approved by 3 Clicks Internet Services. Illegal and/or unauthorized use of the Services, including collecting usernames and/or email addresses of Members by electronic or other means for the purpose of sending unsolicited email or unauthorised framing of or linking to the Website is prohibited. Commercial advertisements and other forms of solicitation are prohibited. Links may be removed at our discretion for any reason with no notice. Legal action may be taken for any illegal or unauthorised use of the Services or the Website.

Proprietary Rights to Content on the Website.

E-mail Policy:

Indemnity:

You agree to indemnify and hold 3 Clicks Internet Services, its subsidiaries, and affiliates, and their respective officers, agents, partners and employees, harmless from any loss, liability, demand, claim or legal proceedings brought or threatened, including expenses of any character suffered or incurred arising out of your use of the Website or the Services in violation of this Agreement, and/or arising from your use of or conduct on the Website or in use of the Services and/or a breach of this Agreement.

General

The Site is controlled by 3 Clicks Internet Services Limited from its location within Ireland. 3 Clicks Internet Services makes no representation that Materials are appropriate or available for use in other locations, and access to them from territories where their content is illegal is prohibited. Those who choose to access this Site from other locations do so on their own initiative and are responsible for compliance with applicable local laws.

Any disputes, claims or proceedings arising out of or in any way relating to the Materials or the Site shall be governed by the laws of Ireland. The Irish Courts shall have exclusive jurisdiction for the purpose of any proceedings arising out of or in any way relating to the Materials or the Site. This AGREEMENT constitutes the agreement between you and 3 Clicks Internet Services Ltd with respect to the use of the website operated by 3 Clicks Internet Services Ltd.

Changes

Any changes to this Agreement will be posted on the Site and will take immediate effect.

Refund Policy

If you take out one of yearly packages we expect you to commit for this period of time. Because of your commitment, we offer a discount on the normal monthly price of our accounts. If you cancel your account within your service period then 3 Clicks Internet Services will not make any refunds on any unused portions of your account. While we do not offer refunds for pro-rata service you have no obligation to continue using our service.
If you opt to pay monthly by direct debit, you may of course cancel your subscription or membership at any time by notifying your relevant Bank or Building Society. By paying monthly, you are not committed to continue paying if you decide to discontinue using the service.
In the event that 3 Clicks Internet Services terminates your account for violation of these terms and conditions you will not be entitled to the return of any fees paid with respect to any such terminated account service.
If you have opted to pay the Annual Subscription and wish to cancel, you may cancel at any time by following these steps:

Send us a fax clearly indicating which subscription you want terminated.
Send an e-mail to accounts@3clicksproperty.com informing us of your cancellation
Write to 3 Clicks Internet Services Ltd informing us of your cancellation

Once you cancel at least 10 calendar days before the next billing period, you will not be charged.

Service to Estate Agents

Credit / Payment

Credit Terms are not provided
The customer is responsible for all charges on the service account until a written cancellation request is received by standard mail or fax, signed by the Administrative Contact for that account. When paying by Credit or Debit card, your card will automatically be billed the agreed amount on the recurring anniversary (monthly or annually) unless notice is received in writing to the contrary or you modify your billing profile.
If your account/service is activated before payment is made then payment must be sent in full by return.
If payment is not made in full within 14 days your account will be suspended on our systems. If payment is still not made in the following 7 day period, your account will be deleted and all services will cease.
If paying monthly, you will receive a monthly statement by email to your registered Administrator Account email address. The admin email address specified in your login administrative panel will receive all invoices, statements and notices and must be kept up to date. 3 Clicks Internet Services takes no responsibility for suspension of services where the customer has not maintained accurate contact information in the control panel.
Any refused/returned payment, by Credit Card, Laser Card, Standing Order, Direct Debit or Cheque, will result in an administration fee of €5 being applied to your account.

Security

Your password provides access to your account. It is your responsibility to keep your password secure.
Sharing your password and account access with unauthorized users is prohibited. You should take care to prevent others from using your account since you will be held responsible for such use.
Attempting to obtain another user's account password is strictly prohibited, and may result in termination of service.
You must adopt adequate security measures to prevent or minimize unauthorized use of your account.
You may not attempt to circumvent user authentication or security of any host, network or account. This includes, but is not limited to, accessing data not intended for you, logging into or making use of a server or account you are not expressly authorized to access, or probing the security of other networks. Use or distribution of tools designed for compromising security is prohibited. Examples of these tools include, but are not limited to, password guessing programs, cracking tools or network probing tools.
You may not attempt to interfere with service to any user, host or network ("denial of service attacks"). This includes, but is not limited to; "flooding" of networks, deliberate attempts to overload a service, and attempts to "crash" a host.
Users who violate systems or network security may incur criminal or civil liability. 3 Clicks Internet Services will cooperate fully with investigations of violations of systems or network security at other sites, including cooperating with law enforcement authorities in the investigation of suspected criminal violations.
